Live Date Script

Hi,
I have a question on this script http://www.dynamicdrive.com/dynamicindex6/clock3.htm.
As of right now my website is W3C validated I tried to validate the page after adding this script not valid now, the <b> <font> <small> tags it says has an end tag but no start tags which it has the start and end tags.
I am using this header for HTML
!DOCTYPE HTML PUBLIC "-//W3C//DTD HTML 4.0 Transitional//EN"
HTML LANG="en"

Do I need to have any xhtml header added to this, I have never used xhtml before?
