The easy way to check if something is flash or not is to right click on top of it and see what menu comes up. If the menu appears normal (for that of an image, text, background, etc.) it is not flash. If a menu comes up asking to zoom in, with an option for quality, and usually saying flash, and probably play, then that IS flash.
This menu varies by browser, but it's easy enough to tell... just find something you know is flash... the menu will always be the same... so see if they match. Once you've see it, you won't forget.
(The only exception here could be if the page has some strange layers effect where there is actually something over the flash, like a div, semi-transparent image, etc. However, you can always check by looking at the source code of the page, but that's a lot harder than right clicking, obviously.)

Really, you can just copy their source code. Or upload their file after getting it from their cache.
    But that's illegal.
Anything on someone's site is copywritten.
To use it, get permission from them, or recreate something like it using flash.
