Scroller not working with xhtml tags [Archive]

1) Script Title: Mike's DHTML Scroller

3) Describe problem:
I've realized that the scroller does not work when my page contains the following tags at the very beginning of the page's code:
<!DOCTYPE html PUBLIC "-//W3C//DTD XHTML 1.0 Transitional//EN" "http://www.w3.org/TR/xhtml1/DTD/xhtml1-transitional.dtd">

Is there a way (besides remove them) to make the scroller work with that declarations?

if dont want to use this xhmtl tags below, there be two ways to avoid this tags.

1st option) you can put into a seprate file. And just include it on those pages only in which scroller dosn't required.

2nd option) You just check for a existance of a page in which scrooler used with if condition .
